Implementation of the arrests made by the Civil Servant Investigators (investigators) in forestry as in pretrial decision number 02 / PID.PRAP / 2014 / PNJKT.PST, number 10 / Pid.Pra / 2009 / PN.PTK, and number 01 / Pid. Pre / 2009 / PN.Siak not in accordance with applicable regulations, so caught up applying pretrial arrest against him. The problem in this thesis is how the official authority of the Civil Servant Investigators (investigators) forest in the arrest and pretrial judge whether consideration in assessing the authority of the Civil Servant Investigators (investigators) to make an arrest in the case of the pre-trial is in conformity with the legislation.
After doing research by using descriptive or normative legal research, data sources supported by three legal materials, namely: primary data, secondary data, and the data tertiary, while the data collection techniques to the study of literature, after the data collected then analyzed qualitatively to answer the problem in this thesis and conclusion by deductive way.
Based on the research that the decision in pretrial number 02 / PID.PRAP / 2014 / PN.JKT.PST and number 10 / Pid.Pra / 2009 / PN.PTK judge stated that the arrests were carried out by investigators not in accordance with the provisions of law valid and has violated Article 18 of the Criminal Procedure Code which instantly arrests carried out by the Civil Servant Investigators (investigators) and not in accordance with Perkapolri No. 6 of 2010 Concerning Management Investigations By Civil Servant Investigators. While in pretrial decision number 01 / Pid.Pra / 2009 / PN.Siak, the judge rejected the request for the arrest of the applicant and the applicant was declared invalid because the judge consider a rebuttal of the defendant. Ie at the time of arrest, the defendant was on patrol and found the applicant who is conducting logging activities and make the planting hole at the forest site. And immediately arrest, the arrest of the applicant carried out in the case caught the hand that is in accordance with Article 18 Paragraph (2) Criminal Procedure Code which caught red-handed in terms of personnel or any person is obligated to arrest the perpetrators and any evidence handed over to the nearest police investigators.
