Private radio stations that do not have radio station licenses in recent years have had wide-ranging impacts in various sectors of life. The most affected sectors are the telecommunications sector which resulted in overlapping of frequency channels. Private radio broadcasting is closely related to radio frequency spectrum and satellite orbit, Article 33 Paragraph (1) of Law Number 36 Year 1999 concerning Telecommunication states "The use of radio frequency spectrum and satellite orbit shall be authorized by the government" and Article 53 paragraph (1) "Anyone who violates the provisions referred to in Article 33 paragraph (1) or article 33 paragraph (2) shall be punished with a maximum imprisonment of four (4) and / or a fine of no longer Rp.400.000.000 (four hundred million rupiahs) .
In accordance with the description above, the authors are interested to conduct research with the title of investigation of criminal acts of radio frequency spectrum use without radio station permit (ISR) by private broadcasting radio (research in radio frequency spectrum monitor Hall class II Pekanbaru). Then to find out the obstacles faced in the investigation of private radio broadcasting that does not have a radio station license. The last objective is to know the efforts made to overcome obstacles in the process of investigation of private radio broadcasting that does not have a radio station license. In writing this skirpsi, the author uses an approach that is empirical or sociological law research. Research location at Radio Frequency Monitoring Hall Class II Pekanbaru. Data sources are supported by primary, secondary data sources. While the data collection technique is the interview And the study of data using deductive method that is analyzing the problems of a general nature then drawn to conclusions in particular based on existing theories.
The result of the discussion in the writing of this thesis is, first, that the investigation of private radio broadcasting crime which has no license of radio station has been running as it should not have been optimum as expected. Secondly, the obstacles in the process of investigating private radio broadcasters that do not have radio station permits include the lack of public legal awareness, limited funds, the number of personnel available, and the lack of facilities and infrastructure. Third, the efforts made by the Radio Frequency Monitoring Unit of Class II Pekanbaru include, performing effective and efficient actions in managing limited funds, using available facilities and infrastructure, and optimizing the work of personnel from the number of personnel available.

ABSTRAK
Stasiun radio swasta yang tidak memiliki izin stasiun radio belakangan ini telah memberikan dampak yang saat luas diberbagai sektor kehidupan. Sektor yang paling terkena dampaknya adalah sektor telekomunikasi yang mengakibatkan tumpang tindihnya saluran frekuensi. Penyiaran radio swasta mempunyai kaitan erat dengan spektrum frekuens radio dan orbit satelit, Pasal 33 ayat (1) Undang-undang Nomor 36 Tahun 1999 tentang Telekomunikasi menyebutkan “Penggunaan spektrum frekuensi radio dan orbit satelit wajib mendapat izin pemerintah” kemudian Pasal 53 ayat (1) menyebutkan “Barang siapa yang melanggar ketentuan sebagaimana dimaksud dalam pasal 33 ayat (1) atau pasal 33 ayat (2), dipidana dengan pidana penjara paling lama empat (4) dan atau denda paling lama Rp.400.000.000 (empat ratus juta rupiah).
Sesuai dengan uraian diatas, maka penulis tertarik untuk melakukan penelitian dengan judul penyidikan terhadap tindak pidana penggunaan spektrum frekuensi radio tanpa izin stasiun radio (ISR) oleh radio penyiaran swasta (penelitian di balai monitor spektrum frekuensi radio kelas II Pekanbaru). Kemudian untuk mengetahui hambatan yang dihadapi dalam penyidikan terhadap radio penyiaran swasta yang tidak memiliki izin stasiun radio. Terakhir bertujuan untuk mengetahui upaya yang dilakukan untuk mengatasi kendala dalam proses penyidikan terhadap radio penyiaran swasta yang tidak memiliki izin stasiun radio. Dalam penulisan skirpsi ini, penulis menggunakan pendekatan yang bersifat empiris atau penelitian hukum sosiologis. Lokasi penelitian di Balai Monitor Frekuensi Radio Kelas II Pekanbaru. Sumber data didukung oleh sumber data primer, sekunder. Sedangkan teknik pengumpulan data adalah wawancara dan kajian data menggunakan metode deduktif yaitu menganalisa permasalahan yang bersifat umum kemudian ditarik pada kesimpulan secara khusus berdasarkan teori yang ada.
