The strength of evidence deed under hand sale and purchase agreement as evidence in court proceedings connected with the legalization and notary authority waarmerking. Pursuant to Article 1874, 1874 (a), and the 1880 Civil Code to evidence a letter or certificate under the hand there should be legalization and waarmerking from the authorities. This study aims to determine the strength of the deed under the hand as evidence in court proceedings, to determine whether or not the function of legalization and waarmerking on deed made under arms provide additional strength of evidence in a trial in court. And the judge can cancel the deed under the hand that has obtained the legalization and waarmerking of Notary.
The method used is the research literature that is normative, ie to discuss and analyze issues relating to the strength of evidence deed under the hand associated with the legalization and notary authority waarmerking in a trial in court.
The results showed, that the function of legalization by notary deed under the hand over, to give certainty to the judge about the date, identity and signature of the parties concerned, so as to provide additional strength of evidence in a trial in court, and the function waarmerking the deed under the hand just give certainty the date of registration of the deed. Deed under the hand that has obtained the legalization and waarmerking of Notaries, can be canceled by the judge if requested cancellation by one of the parties to the agreement based on the evidence that is sufficient, partly because of subjective requirements are not fulfilled in deed pursuant to Article 1320 Act Civil Code. Notary should be more careful in deed, including in legalizing and mewaarmerking deed made under the hand, because in practice often found false identity.
