The application of children's diversion through penal mediation in the Kampar community by the Police is still not running maximally.. On data for the year up to the year 2015 to2017 criminal acts committed by children is increasing, so it is necessary for the police to undertake appropriate action to handle it. The purpose of writing this thesis, that is the first implementation of the diversion as a form of criminal settlement with penal mediation in Kampar, Second, the concept of the ideal application of diversion in Indonesiacriminal law.
In writing this thesis the author uses sociological research methods. The nature of the research used is descriptive, the data used are the primary data and secondary data, data collection techniques using interviews and literature study. The research was conducted at the Police Resort Kampar. The research was conducted at the Police Resort Kampar.
From the results of the study and discussion it can be concluded that, firstly, the investigation carried out by the investigator in the Kampar District Legal Police has not been running in accordance with the existing provisions. There are some crimes that are likely to be diverted, but because of the inadequate ability of investigators to convince the victim of the effects of diversion for children, and there are some diversion exercises that do not receive counseling from a preliminary counselor. Second, Even though it has been regulated in the Act, there are still weaknesses to the diversion process. Sometimes the apparatus is still hesitant to run it, this is because the demands of society, politics, or other consideration of the apparatus. The success of diversion lies in the investigator who is able to provide an understanding of the community regarding the implementation of diversion for the handling of cases conducted by the child.
