The issues related to the policy of late have not been processed and snared with Corruption Act, causing polemic. Lately the most widespread corruption case and much of the spotlight is about gratification. Many media reports on officials at both central and regional levels and law enforcement officials are involved in gratification and corruption cases
This research is done by using normative approach that is legal principles. The type of data used in this study is to use secondary data that is the primary legal material (the 1945 Constitution, the Law, and the Criminal Code, secondary legal materials (books relating to research results are capital punishment in the criminal act of corruption and data from the internet) and tertiary legal material (Big Indonesian Dictionary), data collection techniques in this study with literature study and data analysis using deductive method is a way of drawing conclusions from general to specific arguments. a crime that occurs is inseparable from the existence of elements of criminal liability concerning the maker of the offense itself, which includes the ability to be responsible, the error in the broad sense and the absence of excuses and justification Gratification declared as a criminal act of corruption since the arrangement inside The Act on Eradication of Action idana Corruption. Reversing the burden of proofing is the obligation of a defendant to prove that his property is not the result of a criminal act of corruption The author's suggestion, the Government together with the legislature must immediately make improvements to the formulation of reversal of the burden of proof as contained in the Act of corruption in order for the provisions which governs the burden of proof reversal system is not a "dead" article and the system of reversing the burden of proof must be done at the time of proceedings in court
