ABSTRACT
In this increasingly modern era, the need for goods and / services
needed by consumers is increasing, especially telecommunications services. This
increased need also demands an increase in the quality of services and the
responsibility of business actors or telecommunications service providers.
Therefore, in order to provide a balance between the two parties, business actors
or telecommunication service providers make an agreement prior to the
establishment of a legal relationship between consumers and business actors in
order to achieve a balance, but there are still many cases of consumers who are
disadvantaged by business actors. One of the problems that consumers often
experience is the quality of services offered is not appropriate and vice versa
business actors also experience losses caused by consumers who do not pay and
return equipment in the form of modems. The problems discussed are regarding
how to regulate the legal relationship between consumers of IndiHome Fiber
service customers and PT. Telkom, the obstacles experienced by business actors
are customers who do not pay fees according to the predetermined time, and
customers who stop subscribing but do not pay fines and return the equipment
(ONT / Modem / STB) installed at the customer's house is Telkom's property that
was lent. while being a Telkom customer
The research method of this thesis uses the normative juridical legal
research method, which refers to the legal norms, this research is descriptive in
nature. The data used are primary data and secondary data. The data collection
method is library research (library research), which is conducting research using
data from various reading sources, such as legislation, books, the internet whose
values are relevant to the issues discussed and interviews with related parties are
also carried out to get facts in the field.
The results of this study regarding the implementation of the agreement
between PT.Telkom and IndiHome customers in providing Internet services in
Pekanbaru have not been fully implemented properly, because the modem device
which belongs to PT.Telkom is not returned by the customer. The effort made by
PT. Telkom is waiting for the good faith of the customer in returning the
equipment (ONT / Modem / STB) that was installed at the customer's house is
OWNED by TELKOM which was lent while being a TELKOM customer. Modems
that are not used due to migration to fiber are pulled back.
