Tanggung Jawab Negara Penerima (Receiving State) Terhadap Keamanan Gedung Perwakilan Diplomatik Negara Pengirim (Sending State) Menurut Hukum Diplomatik
ABSTRACT
Attacks to diplomatic premises are hapen over and over, even though the
inviolability of the diplomatic premises had been guaranteed by the Vienna
Convention on Diplomatic Relations 1961. In the convention, the receiving state
was required to make the necessary efforts to protect the diplomatic premises.
This gives rise to the responsibility of the receiving state to protect the diplomatic
premises, so that attempts to attack the diplomatic premises can be prevented. For
this reason, the author is interested in researching “The Responsibility of the
Receiving State for the Security of the Sending State's Diplomatic Premises
According to Diplomatic Law”. With purpose to finding out what are the
responsibilities of the receiving state for the security of the sending state's
diplomatic premises.
This type of research is a normative juridical research with library study
method. The author takes information and instructions from international
agreements (conventions), books, legal journals and others related to the
responsibility of the receiving country for the security of the diplomatic premises.
The author will draw conclusions deductively by drawing conclusions from things
that are general to things that are specific.
The results of this study can be concluded that the inviolability of the
diplomatic representative building raises the responsibility of the state to protect
the diplomatic premises. The responsibility of the receiving state to provide
security protection for the sending state's diplomatic premises can be outside the
diplomatic premises area (Externa Retionale) and also from inside the diplomatic
premises area (Interna Rationale).
