ABSTRACT
Narcotics based on article 1 paragraph (1) of Law Number 35 of 2009 concerning
Narcotics which reads "narcotics are substances or drugs derived from plants, both
synthetic and semi-synthetic, which can cause a decrease or change in
consciousness, loss of taste, reduce to eliminate feeling pain, and can cause
dependence, which are distinguished into groups as attached in this Law”.
Narcotic precursors are substances or starting materials or chemicals that can be
used in the manufacture of narcotics which are distinguished in the table as
attached to this Law.
The type of research carried out can be classified into sociological juridical
research where the research examines the effectiveness of the law that is currently
in effect. This sociological research is a type that is viewed from the purpose of
legal research. Sociological or empirical legal research consists of legal
identification (unwritten) and research on legal effectiveness.
The research objectives of this thesis are; First, the participation of the community
is seen from Article 104 of Law Number 35 of 2009 concerning narcotics which
reads "the community has the widest opportunity to participate and assist in the
prevention and eradication of abuse and illicit trafficking of narcotics and narcotic
precursors. Second, what are the obstacles faced by the Malay community,
Pangean sub-district, Kuantan Singingi Regency in preventing and eradicating
narcotics abuse and illicit trafficking.
From the results of the study, based on the two problem formulations, it can
be concluded. First, so far the community has not fully participated in the
prevention and illicit trafficking of narcotics and narcotic precursors, as can be
seen from the increasing number of narcotics use and circulation in Pangean
District. Second, the obstacles faced by the Malay community, Pangean subdistrict,
Kuantan Singingi Regency, namely the lack of legal awareness of the
community to report to law enforcement if a crime occurs because the community
does not know of the legal protection provided to the complainant.
