Trade unions in the context of building conducive and proportional
industrial (work) relations in safeguarding the interests of workers are very much
needed because they have strategic value. trade unions protect workers from
inability to fight for their aspirations individually, trade unions are needed as
motivators in building democracy, negotiation negotiators and actors in
maintaining work quality, trade unions as a means of communication. Industrial
(work) relations between employers and workers that are not conducive can lead
to disputes over rights and interests due to the deadlock in basic communication
regarding obligations, rights and responsibilities. In order to avoid disharmony in
industrial relations between workers and employers, an autonomous legal
reform/development facility is needed, namely a collective labor agreement
(PKB). Based on these problems, the authors are interested in knowing first, what
is the responsibility of the Trade Unions in fighting for the Rights of Workers at
PT. Tian Seventy Main? Second, what are the efforts and obstacles for trade
unions in carrying out their responsibilities in fighting for workers' rights at PT.
Tian Tujuh Puluh Utama?
This type of research is classified as a sociological legal research. In
normative legal research, the data sources are primary data sources and
secondary data sources consisting of primary legal materials, secondary legal
materials and tertiary legal materials. The normative legal research data
collection uses data collection techniques by means of interviews, questionnaires
and literature studies. The data obtained through the literature study will be
analyzed qualitatively. In drawing conclusions, the writer uses deductive thinking
method, which is a way of thinking that draws conclusions from a general
statement or proposition into a specific statement.
Based on the results of research and discussion, it can be concluded.
First; The implementation of trade unions in the responsibility for workers' rights
at PT.Tian Tujuh Puluh Utama, namely the role of trade unions is proven by the
involvement of the trade unions containing the parties responsible for the
formulation of the CLA. In the negotiations for the making of the PKB, there must
have been complicated negotiations and a long tug of war because there were
conflicting interests of both parties. Second; Efforts and obstacles for trade
unions in providing responsibility for workers' rights at PT.Tian Tujuh Puluh
Utama include, among others, Internal factors such as Human Resources, lack of
communication between management and members, lack of funds and External
factors such as lack of partiality from top management to fulfill rights that are too
demanded by workers, laws that are not in favor of workers.
