Pembentukan Badan Usaha Milik Desa Di Kecamatan Rengat Barat Kabupaten Indragiri Hulu Berdasarkan Peraturan Daerah Kabupaten Indragiri Hulu Nomor 5 Tahun 2011 Tentang Badan Usaha Milik Desa
ABSTRACT
A village is a power or government organization, which clearly has territorial boundaries and has the authority to regulate and manage government affairs and the interests of the local community. In the village, there are various community institutions, one of them is the Village-Owned Enterprise (VOE). VOE is a business entity that is wholly or mostly owned by the village through direct participation derived from the separated village wealth to manage assets, service services, and other businesses for the greatest welfare of the village community. Based on Article 3 of the Regional Regulation of Indragiri Hulu Regency Number 5 of 2011 concerning Village-Owned Enterprises, VOE is formed with the aim of gaining profit to strengthen the Original Village Revenue; Advancing village economy; Increase the village community welfare; and improve the management of existing village assets, such as village treasury land management. From this objective, it can be seen that VOE functions as an engine of the village economy and the welfare of the village community.
This type of research is empirical juridical research or sociological legal research which is a research approach that emphasizes legal aspects related to the subject matter to be discussed, associated with reality on the ground. The research was conducted in VOE in the West Rengat sub district of Indragiri Hulu Regency, while the sample population is all parties related to the problem under study. The data sources used are primary data and secondary data, the data collection techniques in this research are by observation, questionnaire, interview, and literature review.
From the results of this research, there are three main things that can be concluded: First, the implementation of the establishment of village-owned business entities in 6 (six) villages in the western Rengat sub-district of Indragiri Hulu Regency has been carried out which have been poured into Village Regulations but are problematic in the process of formation. Second, the obstacles in establishing a village-owned business entity include the low quality of human resources (HR), which results in the inoperability of the basic duties and functions of the village head, the village apparatus not being empowered, lack of coordination with related parties and village deliberation, lack of publication of Village Regulations on VOE, and the absence of Village Regulations on the capital participation of VOE. Third, the efforts going forward carried out by the village government related to the legality of VOE are to allocate a budget for human resource quality improvement programs, revise the Village Regulations about the establishment of VOE, conduct village deliberations, coordinate with related parties, and empower the potential of the village.
