Penyelesaian Hukum Terhadap Perbuatan Penghinaan Pada Suku Melayu Menurut Hukum Adat Melayu Dumai
In contrast to positive law, in customary law there is no distinction between criminal law and civil law. Settlement of cases in the community is carried out using methods according to customary law. Dumai is a city in Riau Province. With the large diversity of tribes and cultural customs, it is necessary to have an identity as a Malay ethnic group. So a forum for aspirations and creation was formed called the Malay Traditional Institute (LAM) in Dumai. The Malay Traditional Institute (LAM) is an organization operating in the social and cultural sector in Dumai. One of the cases that was resolved according to Riau Malay customary law was a case of insulting the Malay tribe in Dumai City.
The purpose of this research is to find out the customary law regarding acts of insult according to the Dumai Malay Customary Law, and to find out the role of the Dumai Malay Traditional Institution in legal resolution of acts of insult to the Malay tribe according to the Dumai Malay Customary Law, as well as to find out the obstacles faced by The Dumai Malay Traditional Institute is in the process of resolving acts of insults against the Malay tribe.
By using empirical juridical research methods, based on the research results, it was discovered that the resolution of cases of insults against Malays was resolved in accordance with the main tasks of the Dumai Malay Traditional Institution in the Dumai City Regional Regulation No. 3 of 2017 point 6, namely Providing customary sanctions for violations of customary law committed by regional customary law communities, in accordance with customary law provisions. carried out by deliberation and imposed sanctions ranging from light to heavy sanctions, namely making yellow rice, slaughtering animals in the form of chickens, goats and buffalo and throwing away the country which is divided into two, namely throwing away the country within a specified time and throwing away the country without being specified.
