Penyelesaian Sengketa Konflik Rumah Tangga Berdasarkan Hukum Adat Hatobangon Di Desa Sungai Kumango Kabupaten Rokan Hulu
Domestic conflict is a spice in every household which sometimes cannot be resolved between husband and wife or even the families of both parties but requires a neutral third party. In the customs of the Mandailing traditional law community, they are known as hatobangon, namely people who are elders, respected and respected in the Mandailing traditional community, where one of the functions of the Hatobangon is to resolve household conflicts in the community. The people in Sungai Kumango village who still uphold the customs and customary laws that exist in Sungai Kumango village really respect the decisions given by Hatobangon as mediators and consolidators in dealing with domestic conflicts, so that husband and wife can be at peace again. This research aims to find out about the resolution of household conflicts based on Hatobangon customary law in Sungai Kumango village, Rokan Hulu district.
This type of research is descriptive qualitative field research, where the research location is in Sungai Kumango village, Rokan Hulu district. The population in this study consisted of 20 Hatobangon people and 20 husband and wife couples who were in conflict in Hatobangon village so that the population in this study was 40 people, then the sample taken by the author in this study was 4 Hatobangon and 12 people consisting of husband and wife couples who were in conflict. in the village of Kumango River. The data sources used are primary data and secondary data. Data collection techniques are interviews and literature study. Data analysis carried out through research materials will be compiled and analyzed qualitatively.
The results of this research are the function of hatobangon in resolving household conflicts, namely first, providing advice to married couples, second, presenting children/family members from both parties during deliberations, third, providing considerations regarding children and the household, fourth, providing explanation of the rights and obligations of husband and wife, fifth, mediator and sixth, conciliator. The obstacles faced by Hatobangon in resolving household conflicts are first, intervention from the family, second, Hatobangon's readiness and time, third, uncooperativeness of the parties, fourth, the existence of egocentrism on both parties, fifth, distrust of Hatobangon, sixth, second both parties/one of the parties does not want to be reconciled.
