Politik Hukum Pemberlakuan Peraturan Daerah Kota Pekanbaru Nomor 09 Tahun 2014 Tentang Pengelolaan Pasar Rakyat Pusat Perbelanjaan Dan Toko Swalayan Pada Pedagang Kaki Lima Di Pasar Kodim Pekanbaru
Problems in managing people's markets and street vendors (PKL) in Pekanbaru City, especially in the Kodim Market area. Pekanbaru City, as one of the economic centers in Sumatra, is facing big challenges in managing economic growth, urbanization and trading activities, including the management of street vendors ( PKL) which often causes disruption of order, traffic jams and cleanliness problems. The Pekanbaru City Government has regulated market management through Regional Regulation Number 09 of 2014 concerning Management of People's Markets, Shopping Centers and Supermarkets. This Regional Regulation aims to organize markets as a whole, provide legal certainty for traders, and support local economic empowerment. In the context of regional autonomy, studying the legal politics behind the formation and implementation of regional regulations is important to ensure that these policies are able to achieve a balance between the interests of the regional government, the community and the rights of street vendors. It is hoped that this research can provide a comprehensive and fair solution in managing people's markets in Pekanbaru City.
This research is included in Empirical Legal research, because it wants to know the Legal Politics of the implementation of Pekanbaru City Regional Regulation Number 09 of 2014 concerning Management of People's Markets, Shopping Centers and Supermarkets for Street Vendors at the Pekanbaru Kodim Market. This research analyzes the role of Legal Politics in the policy of structuring Street Vendors (PKL) in Pekanbaru City, with a focus on the implementation of Pekanbaru City Regional Regulation Number 09 of 2014. The results of the research show that Legal Politics plays an important role in balancing public interests and the rights of traders. Street vendors as part of the informal economy. This regulation aims to maintain order, cleanliness and urban spatial planning, but its implementation faces challenges due to socio-economic pressures, such as the increasing number of street vendors. This research also found that the implementation of this Regional Regulation involves various agencies, such as the Industry and Trade Service, the Civil Service Police Unit, the Environment and Hygiene Service, and the Pekanbaru City Transportation Service. However, the management of the Kodim Market is currently largely transferred to the private sector through the Build to Handover (BGS) concept, with the government's role being more consultative and supervisory.
The main challenges include conflicts of authority between the government and the private sector, law enforcement that is not yet optimal, and limited infrastructure. Apart from that, the socio-economic aspects of traders also influence the success of the arrangement, because the Kodim Market area is the main source of livelihood for many street vendors. Therefore, a responsive policy approach is needed, taking into account the balance between enforcing regulations and empowering street vendors, to support local economic development and create a more orderly urban layout.
