ABSTRACT
Regional head elections, or local leader election , are held in all regions of
Indonesia to elect regional leaders such as regents and vice regents, mayors and
vice mayors, district heads and their deputies. The democratically organized
regional head elections in Indonesia face a number of challenges that will surely
interfere with people's rights to express themselves in these elections. The
remaining deficiencies are that the restrictions governing the selection of single
candidates are still insufficient, with several legal loopholes that allow certain
individuals to exploit these gaps.
The Constitutional Court's judgment Number 100/PUU-XIII/2015 marked the
commencement of elections with a single candidate. For the first time in the
history of democratic regional elections in Indonesia, an election with only one
pair of candidates. The efforts made in the constitutional court's decision are
intended to preserve the people's right to choose their leaders. There are still
several flaws in this Constitutional Court decision, including as the ballot model
adopted, which results in many invalid or failed ballots in municipal elections
with only one candidate. The vote paper published under KPU rule number 13 of
2018 seeks to mitigate the inadequacies of the previous ballot model, which
resulted in numerous rejected ballots.
However, in the most recent ballot model, there is an issue with the opposition to
the empty box, which can be campaigned for and elected in regional head
elections. If the empty box wins the vote count, the candidate that ran will be
unable to run in the next election. Ideally, this vote model has flaws that require
additional consideration in elections with a single candidate, both in terms of
legalities and in the political context of several Indonesian parties advocating
regional head candidates.
