Pemenuhan Syarat Kawasan Lindung Di Pulau Sumatera Sesuai Dengan Rencana Tata Ruang Wilayah Nasional
ABSTRACT
The island of Sumatra is mandated to have protected areas of at least 40%
of its total area in accordance with Government Regulation Number 13 of 2017
concerning National Regional Spatial Planning based on ecoregions in order to
create balanced environmental management. However, in practice, the existence of
protected areas on Sumatra Island does not reach 40% or 192,317.52 Km2 of the
total area of Sumatra Island, namely 480,793.28 Km2. This situation is caused by
changes in land use and land management or use in protected areas. Therefore, the
aim of the research is first, to find out the current condition of protected areas on
the island of Sumatra. Second, find out the arrangement and distribution of
protected areas for each province out of a total of 40% for the island of Sumatra.
Third, find out what efforts the central government can make to fulfill the shortage
of protected areas on the island of Sumatra in accordance with the regional special
planning plan.
The type of research used is normative legal research with a statutory
regulation approach. This research uses library materials in the form of secondary
data sources consisting of primary legal materials, secondary legal materials and
tertiary legal materials. Data collection techniques were carried out using
literature review methods from various sources including statutory regulations,
books, articles and scientific research, as well as internet websites and supported
by interviews. The data analysis method uses qualitative analysis and conclusions
are drawn using the deductive method from general statements to specific
statements.
From the research results, it was concluded: first, the protected areas on
Sumatra Island are only sufficient for around 24% or a shortfall of 16% of the total
40% that should be met by Sumatra Island which is caused by land conversion,
granting of permits in protected areas, illegal use of land by the community in
protected areas and the state of environmental deforestation every year. Second,
the regulation of protected areas is contained in Government Regulation Number
13 of 2017 concerning National Regional Spatial Planning using the method of
dividing each province into one ecoregion on Sumatra Island to fulfill the shortage
of protected areas on Sumatra Island. Third, efforts that the government can make
are to improve planning, improve patterns and mechanisms for distributing
percentages of protected areas for each province based on ecoregions, utilize
abandoned Industrial Plantation Forest (HTI) areas into conservation or protected
areas, and require companies with plantation management permits to include a
protected area allocation plan of 20% of the total area to be managed accompanied
by a comprehensive strategic environmental study (KLHS) in accordance with the
regional special planning plan.
