ABSTRACT
The number of elderly people is quite large and it is predicted that there will be an increase every year, bringing Indonesia into the era of an old population structure. This has an impact on increasing the number of elderly prison inmates. The problem of over capacity, which is also related to the problem of over budgeting, ultimately disrupts the fulfillment of their rights as vulnerable people in correctional institutions. In fact, the only right that prison inmates are deprived of is freedom, so their other human rights must still be respected.
Therefore, the aim of this thesis research is first, to understand the urgency of the idea of granting pistole rights to elderly prisoners who have been sentenced to prison. Second, knowing the ideal idea of granting pistole rights to elderly prisoners who have been sentenced to prison.
This type of research can be classified into a type of normative legal research using data sources in the form of secondary data with data collection techniques using the literature review method. Then, the data is analyzed and processed qualitatively, and produces descriptive data for further conclusions to be drawn deductively.
From the results of the research, there are two main things that can be concluded, namely first, there are four urgencies for granting pistole rights to elderly prisoners who have been sentenced to prison, namely that the increase in the number of elderly people has implications for an increase in the number of elderly prison inmates, the elderly as a vulnerable group guaranteed by law, changes in the conception of prisons which seek to change the criminal law to be more humane by prioritizing humane treatment of prison inmates, and changes in the conception of prisons which seek to change the criminal law to be more humane by prioritizing humane treatment of prison inmates. Second, the ideal idea of giving pistole rights to elderly convicts who are sentenced to prison is realized by giving them to elderly convicts who are sentenced to prison. Then, the pistole right in question will experience an expansion of its meaning with the mechanism for granting it based on a doctor's recommendation and approval from correctional assessors, and this right is also excluded for recidivists. Next, this arrangement of ideas will be included in the Corrections Law and harmonized into related regulations, as well as socialized to the public. The author's suggestion is to realize this idea in order to guarantee the fulfillment of the rights of elderly prisoners who have been sentenced to prison and that comprehensive regulations regarding this matter are needed.
