Problematika Penegakan Hukum Dalam Penerapan Sanksi Pidana Terhadap Gelandangan Di Kota Pekanbaru
ABSTRACT The issue of homelessness in Pekanbaru City is a complex social problem that urgently needs to be addressed. The presence of homeless individuals often disrupts public order and creates discomfort for residents who perceive them as a threat to public safety. This situation is caused by various factors, with the increasing number of homeless individuals indicating underlying structural problems, such as poverty and injustice. Despite the implementation of various regulations, such as Article 505 of the Criminal Code (KUHP) and Pekanbaru City Regional Regulations No. 12 of 2008 and No. 13 of 2021, law enforcement against the homeless still faces challenges. One of the main issues is the non-application of criminal sanctions, which should serve as a law enforcement instrument to create a deterrent effect. Therefore, this research aims to investigate the issues surrounding law enforcement in the application of criminal sanctions against the homeless in Pekanbaru. This study employs a sociological approach with a descriptive method. It utilizes primary legal materials, secondary legal materials, and tertiary legal materials. Data collection techniques include interviews with the Head of the Regional Law Enforcement Division of the Pekanbaru City Civil Service Police, the Head of Social Rehabilitation at the Pekanbaru City Social Service, and distributing questionnaires to 154 respondents from the community. Additionally, a literature review was conducted, involving the exploration and analysis of relevant literature related to the discussed issues. This activity aims to identify secondary data sources that can support the research using various documentation materials, such as books, journals, regulations, magazines, and other relevant archives. Data analysis techniques involve processing the collected data and legal materials to select those with good validity, followed by systematic management of the data.The research findings indicate that the application of criminal sanctions against the homeless does not resolve the problem. Conversely, a more humane and progressive approach is needed for effective law enforcement. Collaboration between the government, social institutions, and the community is crucial to creating inclusive and sustainable solutions. Fair and effective law enforcement must consider the social and economic context of the homeless. This research recommends enhancing collaboration between the government and social institutions to effectively address homelessness. Policies should focus more on human rights and social support rather than punitive actions. Long-term rehabilitation programs are also essential to reduce the number of homeless individuals and help them reintegrate into society more effectively. Thus, law enforcement can be carried out fairly and sustainably, creating a safer and more prosperous environment for all.
