ABSTRACT
Corruption is an extraordinary crime that can be committed by anyone,
including members of the military who have special laws. Corruption crimes
committed by military members together with civilians in the provisions of the
criminal procedure law must be resolved using the connection mechanism.
However, in its implementation, the connectivity mechanism is often sidelined
because of the Military Justice Law which specifically regulates the authority of
military courts to adjudicate criminal acts committed by military members. The
clash of regulations and judicial authority has led to the implementation of
connectivity mechanisms as a form of transparency and coordination that is not
optimal in resolving corruption crimes involving military members and civilians.
Therefore, the purpose of the research is first, to describe the settlement of
corruption crimes committed by military members and civilians using a
connection mechanism. Second, knowing the ideas related to the arrangement in
the settlement of corruption crimes committed by military members together with
civilians using the connectivity mechanism.
This type of research is classified as a type of normative juridical
research. This study uses library materials in the form of secondary data sources
consisting of primary legal materials, secondary legal materials, and tertiary
legal materials. The data collection technique is carried out by the method of
literature review from various sources which includes laws and regulations,
books, articles and scientific research, as well as internet websites. The data
analysis method uses qualitative analysis by analyzing, interpreting, and
categorizing to obtain secondary data that is descriptive, accompanied by
interpretation of legal materials. Conclusions are drawn using a deductive
method from general statements to specific statements.
From the results of the study, conclusions were drawn: first, the settlement
of corruption crimes committed by military members and civilians is carried out
by coordination between law enforcement agencies. The results of the
investigation by the Permanent Team will then determine the court that has the
authority to adjudicate. Second, the idea of updating the regulation of the
settlement of corruption crimes committed by military members and civilians can
be done by updating the Military Justice Law. In addition, the Military Justice
Law is contrary to other regulations governing the connectivity mechanism.
Renewal can be carried out because there are special conditions and
circumstances that apply, namely the transfer of military coaching to the Supreme
Court. The update aims to harmonize and adjust regulations in order to achieve a
more effective implementation of connectivity mechanisms.
