ABSTRACT The issue of authority in reviewing Government Regulations in Lieu of Laws (Perpu) is a contemporary problem in the realm of Indonesian Constitutional Law which is interesting to discuss based on the perspective of the 1945 Constitution which is the country's basic constitution, this is an effort to revitalize knowledge to move towards better change. and dynamic in the legal realm. So there is great hope that the results of the study or discussion of this problem can become something useful for all of us in carrying out national and state life under the auspices of a constitution that approaches justice for all Indonesian people. The purpose of writing this thesis is: first, to find out how the legal regulation of the presidential veto right on draft laws in Indonesia and the United States is. Second, to find out the similarities and differences in the presidential veto right to draft laws in Indonesia and the United States. Third, to find out the advantages and disadvantages of the president's veto right to draft legal regulations in Indonesia and the United States. The research method in this thesis uses normative juridical research, namely research that focuses on examining the application of rules or norms in positive law. The nature of this thesis research is descriptive research that systematically describes the facts and characteristics of the object being studied accurately. The data sources used are primary, secondary and tertiary data sources. The data collection method used in this research is firstly literature study, which is a technique for obtaining secondary data through documents related to the problem, objectives and benefits of research, then after the data collected and then analyzed to draw conclusions. Based on the research results, Constitutional Court Decision No. 138/PUU-VII/2009 is a decision that opens the gates for reviewing government regulations in lieu of laws which makes the Constitutional Court increase its own authority even though the authority of the Constitutional Court has been regulated in Article 24C of the 1945 Constitution, so that the Constitutional Court's decision creates a two-in-one phenomenon in testing. Apart from that, the Constitutional Court through this decision also changed the textual content of the 1945 Constitution, even though this is within the authority of the People's Consultative Assembly.
