Subjek Hukum Yang Bertanggung Jawab Terhadap Sampah Plastik Di Samudera Menurut Hukum Internasional
ABSTRACT
The sea is one of the ecosystems that experiences the greatest damage
as a result of the presence of marine debris, especially plastic. In the
northern Pacific Ocean, rubbish from countries directly bordering the Pacific
Ocean gathers there and gives rise to a large collection of rubbish, which is
called the great Pacific garbage patch. The Great Pacific Garbage Patch is
then divided into 2 parts, namely the collection of waste located between
Hawaii and Japan which is called the Western Garbage Patch and the
collection of waste located between Hawaii and California which is called
the Eastern Garbage Patch. The main problems in this research are: How
international law regulates responsibility for plastic waste in the ocean;
Which subject of international law is responsible for handling plastic waste
pollution in the oceans? The theories used in this research are the
Responsibility Principle theory and the Precautionary Principle theory.
The type of research used in this research is normative legal research.
Normative legal research is a process of finding legal rules, legal principles
and legal doctrines to answer the legal issues faced. This research focuses on
legal synchronization, namely examining the harmony of positive law
(legislation) so that it does not conflict based on the hierarchy of laws and
regulations.
The results of this study are the subjects of international law
responsible for plastic waste in the ocean, namely the State as the main
subject that has the legal capacity to make agreements, bind, be bound by
legal obligations, and can be held accountable for violations of international
law including in terms of environmental pollution. The form of responsibility
of the subjects of international law responsible for handling plastic waste
pollution in the ocean gives rise to two forms of responsibility, namely
responsibility and liability.
