ABSTRACT
The implementation of Government Regulation No. 18 of 2021 in the Tenayan
industrial area has not been realized properly and has not been implemented optimally
considering the many land problems in the Tenayan industrial area. Regulations for data
collection and land compensation processes for the public interest already exist. In fact, we still
find discrepancies between the data and the facts in the field that occur. In terms of data
collection, the government should work together and coordinate so that there are no data errors
that are detrimental to both parties. The land transfer process will never be free from the problem
of compensation, if an agreement has been reached regarding the price, then the compensation
payment will be made and then continued with the release or transfer of rights to the land in
question. To prevent discrepancies in compensation, double certificates, even land that is indeed
the community's right to be taken by force by the government, data collection in accordance with
regulations or regulations must be determined and implemented.
The efforts made by the Pekanbaru government are in accordance with the conditions
in the field. However, what has attracted attention is why when the community is already in
turmoil the government has just intervened. In essence, the government must resolve before the
problem occurs and of course the government must be careful in conducting data collection.
Furthermore, the government must often be involved in this land problem, because if the
community is left alone, this problem will not be resolved. Therefore, if mediation, deliberation
and negotiation have been carried out, if they are still unable, then the government must continue
to the litigation path in order to create comfort in land management. In this resolution, the
government makes efforts through non-litigation, namely by negotiating and deliberation to reach
an agreement or one voice between the city government and the community who have felt
disadvantaged.
Sociological research is research conducted by conducting a direct review of the
research location. In this case, the author conducted research on the Implementation of
Government Regulation Number 18 of 2021 concerning Management Rights, Land Rights,
Apartment Units, and Land Registration in Terms of Data Collection and Settlement of Community
Land Rights in the Tenayan Industrial Area (Kit) of Pekanbaru City, which was studied at the
Pekanbaru City DPRD.
The results of this study are that the data collection and resolution of land rights disputes in the
community in the Tenayan Industrial Area of Pekanbaru City by the City Government still
experience many obstacles and problems in the field. The settlement is quite difficult even though
Government Regulation Number 18 of 2021 has been issued to resolve this case, but the
implementation in the field is still not carried out, so that many people complain and become
rebels. Furthermore, with the existence of rebels and complaints from the community, the
Pekanbaru City Government has made efforts to resolve this obstacle by conducting re-data
collection, compensation, deliberation and forming a justice team for operational checks in the
field.
The conclusion of this study is that when people complain and do not want to leave the land for
any reason, it will be recorded in the field, whether it is because they are harmed by the
government or not. The justice team checks and helps with data collection in the field in order to
obtain data and this problem can be resolved immediately.
