Analisis Putusan Pengadilan Terhadap Ketentuan Pasal 24 Undang-Undang Nomor 12 Tahun 2022 Tentang Tindak Pidana Kekerasan Seksual
ABSTRACT
Sexual violence comes from two syllables, namely violence and sexual,
which in English is called sexual hardness. The word hardness means hard,
unpleasant and not free. Thus, sexual violence is an unpleasant act or act against
sexuality. Sexual violence is a crime that has affected the lives of many people
throughout history and today. Because it can happen to anyone.
The formulation of the problem and the purpose of this research is about
the crime of sexual harassment and sexual violence in Indonesia, what is included
in the crime of sexual violence, evidence in the crime of sexual violence in
accordance with article 24 of Law number 12 of 2022 concerning the Crime of
Sexual Violence, and to find out the analysis of the decision of the Pekanbaru
District Court No.46/Pid./B/2022/PN. PBR. This type of thesis research uses the
type of normative legal research and uses secondary data collection techniques
consisting of primary and secondary data materials.
Decision of the Pekanbaru District Court NO.46/Pid./B/2022/PN. PBR is a
verdict on the crime of sexual violence where the Judge decides that the defendant
is not legally proven to have committed the crime of sexual violence after the
existence of evidence and evidence presented in the trial.
The conclusion that the author can reach is that the Crime of Sexual
Violence is a very despicable act that can damage the life of the victim both
personally and in the surrounding community. The evidence and evidence
submitted by the victim should be sufficient to impose a criminal sentence against
the defendant in accordance with article 24 of Law number 12 of 2022 concerning
the Crime of Sexual Violence. The author's suggestion is that law enforcement
parties and the government should further strengthen regulations and laws in
terms of rules on sexual violence crimes so that perpetrators who commit sexual
violence crimes are charged with appropriate laws.
