ABSTRACT
Inheritance law is a part of civil law as a whole and is the smallest part of
family law, customary inheritance law is closely related to the scope of human
life, because every human being will experience death. Indigenous people in
Sokop village, Rangsang Pesisir District, Meranti Regency, Riau Province, are
more dominantly women and have a role that equals or even exceeds that of men,
both in terms of education, economy and even social. For the indigenous people
of the Akit tribe, in terms of inheritance, they use an individual inheritance
system, in which the position of daughters and sons is recognized and jointly
receive inheritance from the heir. The purpose of this study is, First, to find out
the implementation of the division of inheritance according to the customary law
of the Akit Tribe Community in Rangsang Pesisir, Meranti Islands, Riau. Second,
to find out the settlement of inheritance disputes according to the customary law
of the Akit Tribe Community in Rangsang Pesisir, Meranti Islands, Riau
This research uses the type of empirical legal research or sociological legal
research. The sample in this research is the indigenous people of the Akit Tribe,
heirs and the Head of Sokop Village. The analytical tool in this study is a
qualitative method. This study found that there were things that were less than
optimal in reality on the ground, so it was necessary to anticipate them with
maximum effort.
This study concludes that, First, the distribution of inheritance according to
the customary law of the Akit Tribe in Rangsang Pesisir, Meranti Islands, Riau is
carried out on the 7th (seventh) day after the heir dies. Inheritance distribution is
carried out in 3 (three) ways, namely grants (aeh heta deceased) made by the heir
during his lifetime, through a will left by the heir to all heirs and distribution of
inheritance after the heir dies. However, the phenomenon that occurs in the
author's research is that there is still injustice in the implementation of the
distribution of inheritance in the Akit Tribe Society. Second, settlement of
inheritance disputes according to the customary law of the Akit Tribe community
in Rangsang Pesisir, Meranti Islands, Riau is carried out in 2 (two) ways, starting
from deliberation (hapat/behonding) of the family led by the eldest son in the
presence of all heirs , as well as Guardians and Inheritors and customary
deliberations (hapat/behonding) which are carried out by the Head of the
Indigenous People of the Akit tribe, namely Bathin in the Traditional house and in
the house of the heirs.
