Perjanjian Pinjaman Online Yang Terkandung Unsur Pasal 1324 Kitab Undang-Undang Hukum Perdata Ditinjaudari Asas Good Faith
This study aims online loan agreements containing elements of article 1324 of the civil code in terms of good faith principle. An online loan is an online-based loan that differs from credit facilities or banking financing in general, that is, it does not require collateral and is done non-face to face, but has many risks. In the formulation, how online loan agreements containing elements of article 1324 of the civil code in terms of good faith principle and how online loan agreements that occur in Indonesia are reviewed from the principles of good faith. This research is a type of normative research, namely library legal research by including research on the principles of law. The method of approach used in this study is a qualitative analysis that is a description of the data collected using the quality of the data or not using numbers but based on laws and regulations and legal exchange opinions. Furthermore, researchers explain clearly and in detail through data interpretation by linking the data linkages with one another and analyzed based on legal theory and applicable legal provisions and opinions of experts, to then draw conclusions by deductive means of drawing conclusions from things that are of a nature general to specific problems.
