Penegakan Hukum Tindak Pidana Peredaran Rokok Ilegal Oleh Bea Dan Cukai Bengkalis
ABSTRACT
Bengkalis Regency is an archipelagic region surrounded by straits in Riau Province. To reach Bengkalis Island via land routes, there is only one alternative, which is through the Roro ferry. This makes it a strategic location for the distribution of illegal cigarettes, as the archipelagic nature of the area provides a crossing route that facilitates smuggling by both large and small vessels. Meanwhile, sea transportation is available through ferries at official ports and small boats (pompong) at illegal ports.
The objectives of this thesis are: First, to examine the law enforcement efforts against the criminal act of illegal cigarette distribution by the Bengkalis Customs and Excise Office. Second, to identify the obstacles in enforcing the law against illegal cigarette distribution by Bengkalis Customs and Excise. Third, to explore the measures taken by Bengkalis Customs and Excise to enforce the law regarding illegal cigarette distribution in Bengkalis. This study is classified as sociological legal research, as the researcher conducted direct field studies at the research location to provide a comprehensive and clear depiction of the issues being analyzed. The research was carried out at the Bengkalis Customs and Excise Office, with the population and sample including all relevant stakeholders. The data sources used comprise primary, secondary, and tertiary data. Data collection techniques involved interviews, questionnaires, and literature studies.
Based on the research findings and discussions, it can be concluded that: First, the law enforcement carried out by the Bengkalis Customs and Excise Office in combating the distribution of illegal cigarettes includes both preventive and repressive measures. Second, obstacles in this process include limitations in human resources, a lack of operational facilities, human resource competence, the vast area of supervision, and the low awareness among the public regarding the dangers of illegal cigarettes, as well as the lack of awareness among illegal cigarette sellers. Efforts to overcome these obstacles in law enforcement against illegal cigarette distribution include increasing the number of personnel, adding operational facilities, and enhancing human resource competence through training and development programs. Additionally, Customs and Excise authorities conduct public outreach and education to raise legal awareness and build synergy with law enforcement agencies and local governments. The suggestions that can be offered are that law enforcement against the distribution of illegal cigarettes by the Bengkalis Customs and Excise needs to be optimized up to the investigation stage so that cases can be processed in court. To address obstacles, additional personnel, improved operational facilities, and the reactivation of monitoring posts are required. Furthermore, these efforts can be strengthened through joint operations, public outreach, and regular training for staff.
