Analisis Hukum Internasional Terhadap Tantangan Ekspor Minyak Sawit Indonesia Ke Swiss Dalam Kerangka Cepa
ABSTRACT
This study aims to analyze the challenges faced by Indonesia in
implementing the CEPA (Comprehensive Economic Partnership Agreement) with
Switzerland, particularly in relation to palm oil exports, and to examine the ideal
CEPA concept that should regulate palm oil exports between the two countries.
Palm oil is one of Indonesia's strategic export commodities that is expected to
benefit significantly from CEPA. However, in practice, Indonesian palm oil
exports to Switzerland face various tariff and non-tariff barriers.
This study uses a normative juridical method with a descriptive analytical
approach. The data used are sourced from primary legal materials in the form of
national legislation (Law No. 1/2021, Presidential Regulation No. 44/2020,
Presidential Instruction No. 8/2018), international agreements (IE-CEPA
Agreement, 1969 Vienna Convention), and secondary legal materials in the form
of literature, journals, and related research results. Data collection techniques
were carried out through literature study, with qualitative data analysis using
legal interpretation and deductive reasoning to draw conclusions.
The results of the study indicate that the main challenges for Indonesian
palm oil exports within the CEPA framework include non-tariff barriers, limited
producer capacity, environmental issues, competition with alternative vegetable
oils, logistical barriers, and technical regulatory inconsistencies. An ideal CEPA
agreement should include harmonization of standards and mutual recognition of
sustainability certification systems, trade facilitation, protection against product
discrimination, technical cooperation and capacity building, as well as balanced
benefit sharing and responsibility. The study recommends that Indonesia develop
a comprehensive strategy, strengthen dialogue and cooperation with Switzerland,
and proactively promote sustainable practices in its palm oil industry to optimize
the benefits of the CEPA.
