Reformulasi Sanksi Terkait Dengan Penanggulangan Kejahatan Manipulasi Informasi Elektronik Yang Menggunakan Applikasi Teknologi Dalam Usaha Transportasi

ABSTRACT
One example of the use of technology in the transportation sector is the
ease with which people access online application-based transportation services
which are currently starting to develop along with the higher level of community
needs. Currently, online-based transportation modes in Indonesia are becoming
very popular in urban communities whose mobility levels are very high. The
presence of online transportation service providers such as Grab, Uber, and
Gojek is welcomed by the community whose current existence is also felt to have
become a necessity that really helps modern society.
This type of research can be classified in the type of normative legal
research, which discloses laws and regulations relating to legal theories that are
the object of research. The approach taken is using a qualitative analysis
approach by searching for data in books, journals and other scientific works
related to this research. The data sources used are primary and secondary legal
materials.
The conclusions that can be obtained from the results of the study are:
First, policy reformulation related to crime prevention, manipulation of electronic
information using technology applications in the transportation business, one of
the rational efforts to overcome crime through the purpose of punishment is also
the most important element in eradicating crime in addition to application and
execution policies. Efforts and the application of relevant sanctions in good
criminal law regulations cannot be separated from the purpose of crime
prevention. With the existence of these crimes, the reformulation of the
manipulation policy is strictly oriented to criminal law policies and the purpose of
punishment so that in addition to the policy level, it also has an impact on
providing ideal punishment for perpetrators. Second, the ideal criminal law policy
for tackling the crime of manipulation of electronic information in the
transportation business aims so that crimes in the field of technology, especially
manipulation can be accommodated into the law in which the ideal concept is
aligned with the purpose of punishment so that the sanctions system can be
achieved both from the policy level and at the level of punishment in practice.
