ABSTRACT
To carry out regional govermment regional heads are needed who
are elected through regional head elections. In carrying out regional head
elections it has regulated in Law Number 10 of 10 2016 concerning Regional
Head Elections. The provisions in article 7 paragraph (2) which determine
that: Citizens of the Republic of Indonesia who can be designated as
candidates for govermor and deputy govermor candidates for regents and
deputy regents as well as candidates for mayor and candidates for deputy
mayors these provisions provide the understansing that every citizen of the
Republic of Indonesia is laoyal to the state. This implies that every citizen of
the Republic of Indonesia is obliged to obey the laws and provisions of the
prevaling laws and regulations in the Republic of Indonesia. The term
citizenship has a meaning that shows the relationship or bond between the
state and citizens.
The type of research used by the author is normative legal research
or what is known as "legal research". Which means that in this legal
research, law is often conceptualized as what is written in the legislation (law
in book) or law is conceptualized as a rule or norm which is a benchmark for
human behavior that is considered appropriate. Determination of the use of
laws and regulations related to research case studies where the candidate
pair for the regional head of the Sabu Raijua district is a candidate who has
dual citizenship.
Law Number 10 or 2016 regulres that everyone can become a
candidate for regional head in accordance with the requirements contained
in the regional head election Law,law Number 12 of 2006 concerning
citizenship and general election commission regulations Number
342/HK.031-Kpt/5320/KPU-Kab/XII/2020 concerming determination of the
results of the recapitulation or vote count results for the election of regents
an deputy regents elected in the Sabu Raijua regent and deputy regent
elections in 2020 requires that each candidate must meet the rewuirements,
one of which is Indonesia citizenship. In the decision of the constitutional
court Number 134/PHK.BUP-XIX/2021 concerming disputes on the results of
the election of regional heads and deputy regional heads Sabu Raijua in its
ruling the panel of judges of the constitutional court stated that constitutional
court has the authority to settle disputes over the results of regional head
elections in this case the Orient Patriot Riwu Kore because it involves
citizenship status that cannot be separated from candidates for regional
heads and deputy regional heads. The panel of judges of the opinion that the
general elections commission in carrying out the regional head election had
an error, therefore the panel of judges of the constitutional court considered
that the determination of Orient Patriot Riwu Kore as a candidate for
regional head had no legal force.
