ABSTRACT This research related to the analysis of the decision of the judge of the Siak District court in civil case number 37/Pdt.G/2018/PN.Sak regarding the determination of compensation for development in the public interest. Based on this decision, there are many things that need to be studied because they are not in accordance with the provisions of existing laws an regulations. Therefore, it is necessary to study stimulatively the first consideration of the judge in the decision of the Siak District court in civil case number 37/Pdt.G/2018/PN.Sak regarding the determination of compensation for development for the public interest.. Second, the suitability of the judge’s decision to the theory of justice according to the Siak district court in civil case number 37/Pdt.G/2018/PN.Sak regarding the determination of compensation for development in the public interest. This research is normative legal research, research conducted based on legal materials, laws and regulations. The approach taken includes a literature approach, namely by studying books and laws and regulations. The types of data used are primary data, namely data sources obtained through laws related to the Determination of Compensation for development in the public interest, secondary data sources, namely data sources derived from books and other regulations consisting of primary legal materials laws and regulations governing compensation for development the public interest. The results of the study concluded, First, the consideration of the judge's decision in civil case number 37/Pdt.G/2018/PN.Sak regarding the Determination of Compensation for Development for the Public Interest has not fulfilled the purpose of the law itself, namely justice and certainty. Second, the suitability of the judge's decision on the principle of justice according to the Siak District Court in civil case number 37/Pdt.G/2018/PN.Sak regarding the Determination of Compensation for Development for the Public Interest is unfair compensation, because if it is related to substantive justice and procedural justice,then the compensation provided must include both justice, but in practice this justice is not implemented.
