Perluasan Makna Korban Tindak Pidana Dari Penyalahgunaan Kekuasaan Berdasarkan Declaration Of Basic Principles Of Justice For Victims Of Crime And Abuse Of Power
The law functions to guard and protect society from state power that
harms it. However, in reality, there has been a lot of abuse of power committed by
government employees, law enforcement officials, the military and even medical
staff which has resulted in many victims suffering physical, mental and economic
losses, such as the case of Ferdy Sambo (the murder of Brigadier Yosua ), Julia
Batubara (procurement of social assistance packages of Indonesian Ministry of
Social goods), Rafael Alun (tax gratuity) and so on. These perpetrators take
advantage of the power they have to commit criminal acts so as to create victims
of criminal acts. However, it is often difficult to identify victims of this kind of
crime or new victims appear quite a long time after the crime occurred, perhaps
even a person does not realize that he has become a victim of a crime of abuse of
power. The first formulation of the problem is what is meant by victims in the
declaration of basic principles of justice for victims of crime and abuse of power,
secondly, what are the implications for the possibility of abuse of power against
victims of criminal acts. The research method in this thesis uses normative legal
research, namely research with library research. The results of the research show
that the meaning of the form of victim protection provided has experienced a lot of
expansion, not only aimed at victims due to a criminal act, but also protection for
victims that can be carried out by the authorities due to abuse of power. Victims
of crime (crimes) and victims of abuse of power, as well as often victims' families,
witnesses and other people who assist victims, unjustly experience loss, damage
or injury, besides that they also suffer difficulties when assisting in the
prosecution of the perpetrators of crimes. The implications for the Possibility of
Abuse of Power Against Victims of Crime show the capability that a person has to
make other people do something, or the potential that a person has to influence
other people. Thus power is the capacity to change the attitude or behavior of
others as desired. Unfortunately, many leaders abuse power, they use power for
the benefit of themselves and their groups, which leads to attempts to use their
position as a tool to deceive others. This will have a negative impact on the
criminal justice process later.
