Penerapan Restorative Justice Terhadap Tindak Pidana Penipuan Dikepolisian Resor Kota Pekanbaru Dalam Perspektif Korban
Restorative Justice is a legal system that aims to restore the welfare of victims, perpetrators and society which focuses on recovery and avoiding retaliation and taking into account the aspirations of victims and the responsibility of perpetrators. The principle of restorative justice in criminal cases must fulfill material and formal requirements. The author's concern is that the relationship between formal requirements in certain cases at the Pekanbaru Police cannot be carried out effectively.The formulation of the problem studied in this research is first, how is restorative justice applied to criminal acts of fraud in the Pekanbaru city resort police from the victim's perspective. Second, how successful will be the handling of criminal acts of fraud in the aspect of law enforcement if it is resolved using restorative justice at the Pekanbaru City Resort Police from the victim's perspective in accordance with Police Regulation Number 8 of 2021.
In conducting this research, the author used sociological legal research methods which were carried out using social research in which scientific activities are based on systematic analysis, methodologically and consistently. The research was conducted at the Pekanbaru City Police Department using population and samples. Researchers collected data consisting of primary and secondary data. Data collection techniques are interviews and literature review. Data analysis was carried out qualitatively and the author drew conclusions using deductive thinking methods.
Judging from the two points of discussion and research above, the author concludes, First, criminal acts of fraud in the Pekanbaru city resort police which implement restorative justice from the victim's perspective in practice in the criminal justice system as well as in judicial practice are relatively little paid attention to because legal provisions still rely on protection for perpetrators. (offender oriented). In fact, from a criminological and criminal law perspective, crime is a conflict between individuals that causes harm to victims, society and the offenders themselves, where the interests of the three groups and crime victims are the main part of the crime. Second, Police Regulation Number 8 of 2021 concerning restorative justice has material and formal requirements in handling a criminal act, however in practice the link to formal requirements in certain cases at the Pekanbaru Police is not effective and new problems arise which could occur due to dissatisfaction on the part of the parties. -the party who feels disadvantaged, especially the victim.
