BPSK Riau Islands Province Tanjungpinang City Working Area in resolving consumer disputes is not in accordance with Article 55 of the UUPK, Article 54 paragraph (3) of the UUPK, which stipulates that the BPSK panel's decision is final and binding, but in practise BPSK cannot impose sanctions on agreements that are not implemented. The purpose of the research conducted is to find out the effectiveness of dispute resolution by mediation and arbitration, to find out the supporting and inhibiting factors, and to find out what efforts are made by BPSK Riau Islands Province Tanjungpinang City Working Area in order to increase its effectiveness in resolving consumer disputes.
The type of research used in this study is sociological research. The research was conducted in Tanjungpinang City, Tanjungpinang Timur Sub-district, and the Consumer Dispute Resolution Agency (BPSK) of Riau Islands Province, Tanjungpinang City Working Area, which became the object of this research case. Then the population and samples are BPSK assemblies, developers, and consumers. As well, data sources used primary and secondary data. Data collection techniques in this research are interviews and literature reviews. The data is analysed qualitatively by describing descriptively the data that has been obtained.
First, the settlement of disputes by BPSK between consumers and developers in the East Tanjungpinang sub-district has not been effective in terms of process and time, and the decision is still not acceptable to the parties, which results in continuing to the District Court. Second, the supporting factors of BPSK Riau Islands Province in resolving disputes through mediation are the good faith of both parties in litigating at BPSK and the ability of the mediator. Besides that, in arbitration, BPSK Riau Islands Province is supported by witnesses and valid authentic evidence. While the inhibiting factors of mediation at BPSK are the lack of members who have legal education and the factors of the parties, besides that, the BPSK inhibitors in arbitration are the absence of business actors according to the time of the trial, the two parties do not have good faith to litigate at BPSK, the main business actor does not have a place to hear cases at BPSK, and the existence of regulations governing this matter. The third effort of BPSK Riau Islands Province of Tanjungpinang City Working Area in order to increase the effectiveness of consumer dispute resolution is to compile technical guidelines and implement dispute resolution signed by the Chairman of BPSK. Related to the developer's obscurity of the arbitration award, a request for execution has been submitted to the Tanjungpinang District Court by BPSK, training to improve the quality and knowledge of BPSK members, submitting additional funding allocations to the Riau Islands Provincial Government for professional improvement, and conducting socialization to introduce BPSK with the aim of making consumers smarter.
