Perlindungan Hukum Terhadap Pengemudi Transportasi Online Gojek Perempuan Berdasarkan Kitab Undang-Undang Hukum Perdata
Labor has a very important role in national development. These resources interact with other development capital, coupled with the role of technology will support development programs in the field of economy and community welfare. Legal protection is any effort made consciously by every person or government or private institution that aims to seek security, control and fulfillment of living welfare in accordance with human rights. Legal protection regarding labor in Indonesia is regulated in Law Number 13 of 2003 concerning Labor. Online-based transportation services in Indonesia began to bloom in 2014. At the beginning of its appearance began by the Uber application that carries Uber Taxi as an online application-based transportation service business. Then followed by the emergence of GOJEK, GrabBike, GrabTaxi, and other online based applications. Facing technological progress should be accompanied by renewal of labor law. Because in carrying out the work there are threats and dangers that can occur to female online transportation drivers, but there are no specific arrangements regarding legal protection for online transportation drivers. In the city of Pekanbaru today has developed with the presence of online drivers who use internet applications The problems that become the object of this research are: First, what are the legal protection arrangements for female online transportation drivers based on Indonesian legislation? Second, does the legal arrangement regarding online transportation drivers provide legal protection for female online transportation drivers ?? This type of research is Normative legal research. The data sources used are secondary data, namely Primary Legal Materials, Secondary Legal Materials and Tertiary Legal Materials. The technique of collecting data uses library studies, because it makes the library material the main focus. In this study the author uses qualitative analysis, in drawing conclusions using deductive thinking methods. The results of this study are First, There are no specific Arrangements related to Legal Protection Against Female Online Transportation Drivers. Because the relationship between service providers and drivers of online transportation is a partner, not a work relationship as referred to in Law Number 13 of 2003 concerning Labor. So that work protection for female online transportation drivers cannot be based on employment protection for women referred to in Law Number 13 of 2003. Second, with no regulation that becomes the legal basis for Legal Protection for Women Online Transportation Driver, meaning that there is no Legal Protection For Women Online Transportation Driver.
