Politik Hukum Presidential Thershold Dalam Perspektif Konstitusi Di Indonesia

ABSTRACT
Political law is a choice of laws to be enforced as well as a choice of laws
to be repealed or not enforced, all of which are intended to achieve state goals as
stated in the Preamble to the 1945 Constitution. One form of this system is
democracy. The rule of law systematically applies democracy in the country.
Indonesia is a constitutional state as contained in article 1 paragraph (3) of the
1945 Constitution. Presidential Thershold or the Candidate Threshold for
President and Vice President is a policy that is in the Requirements for
Nominating President and Vice President by political parties. The provisions
regarding the Terms of Presidential Candidacy have been regulated in Article 6A
of the 1945 Constitution. Presidential Thershold is actually an additional rule of
Article 6A of the 1945 Constitution.
The regulation regarding the Presidential Thershold reaps Pros and Cons
from political circles, controversy arose when Law Number 7 of 2017 concerning
General Elections was passed. In article 222 of Law Number 7 Year 2017
concerning General Elections, it is stated that "Candidate pairs are proposed by
the Election Contesting Political Parties or Association of Political Parties that
meet the requirements for obtaining seats at least 20% (twenty percent) of the
total seats in the DPR or obtaining 25 seats. % (twenty five percent) of the valid
votes nationally in the previous General Election for DPR members.
This type of research is classified into Normative Research by taking an
approach to the Presidential Thershold concept, legal rules, and legal principles
in order to find irregularities in the enforced policies. Data collection techniques
in this research are library research, studying books, journals, regulations and
writings related to this research.
Presidential Thershold or better known as the Presidential Candidate
Threshold is actually an additional rule of the 1945 Constitution of the Republic
of Indonesia in Article 6A. Political Law is the first step in determining the
direction of policy in making new regulations by investigating changes in people's
lives. The Ideal Concept of Arranging a Presidential Thershold is needed in
Indonesia. The purpose of the Ideal Arrangement Concept for the Presidential
Thershold is to initiate, to shape the direction in which the Presidential Thershold
is needed.
