Juridical Strength of Trial Facts in Decision Making by Judge: The Study of Criminal Case Number 1532/Pid.B/2009/PN.Jkt.Sel on behalf of Defendant Antasari Azhar
This minithesis discusses how the judicial strength of trial facts in the proof of any criminal cases. In a criminal case, which sought is the ultimate truth; the judge must be active in looking for it. This ultimate truth must be obtained from the trial facts that emerged through evidences. In addition, to provide a sense of justice for all litigants and the general societies, the judge must formulate the construction of facts in order to vonis verdict. This research is also examining a criminal case that does not show trial facts as the basic judgment for making the decision of the trial, and compare them with a criminal case that uses the trial facts as a basic judgment of the decision-making.
