Model Penyelesaian Melalui Hukum Adat Terhadap Tindak Pidana Penebangan Hutan Mangrove Di Kecamatan Mandah Kabupaten Indragiri Hilir Provinsi Riau
ABSTRACT
One of Indonesia's natural wealth is the mangrove forest ecosystem.
Mangrove forests play a role in maintaining and preserving the life of flora and
fauna that live on the coast. Indonesia is currently experiencing an increase in the
loss of mangrove resources due to the logging of mangrove forests which is
mostly done by local people illegally. Indragiri Hilir is one of the areas in Riau
Province with the largest population of mangrove forests in Indonesia and
Mandah District is an area in Indragiri Hilir which has the largest mangrove
forest with an area of 31,007 hectares. The crime of cutting down mangrove
forests in Mandah Subdistrict, Indragiri Hilir Regency, is often carried out by
local people on a regular basis and illegally. The settlement of the criminal act of
logging mangrove forests in Mandah District, Indragiri Hilir Regency is usually
resolved by the application of customary law because Mandah is a remote area
far from access to formal justice, with high costs (transportation using sea
transportation) making customary law more effective than traditional law. formal
law because customary law is more accepted by the Mandah community than
formal law. The objectives of this study were first to determine the process of
resolving the criminal act of cutting down mangrove forests and secondly to
determine the effect of customary law in resolving criminal acts of cutting down
mangrove forests in Mandah Subdistrict, Indragiri Hilir Regency, Riau Province.
This research belongs to sociological law research, which is research that
seeks to see the correlation between law and society with the gap between das
sollen and das sein. This research was conducted in the jurisdiction of the
Mandah Sector Police and the Mandah Indragiri Hilir Riau LAM, while the
population and samples were the Kapolsek Mandah, the head of the Mandah
LAM, community leaders and communities living in the mangrove forest area in
Mandah. Sources of data used are primary data, secondary data and tertiary data
with data collection techniques through interviews and literature review.
From the results of the research carried out, it is known that problems
related to the problem of mangrove logging are resolved using customary law,
namely resolved by carrying out banana tih processions, bele kampong rituals
and payment of dams or fines for perpetrators of criminal acts of mangrove
logging, and it is known that the existence of Efforts through Mandah customary
law are much more effective in eradicating every criminal act of mangrove forest
because the community is more obedient and obedient to the results of customary
decisions than formal law due to difficult access and lack of community
understanding of formal law.
