ABSTRACT
An agreement is an alliance between two or more parties on the basis of an agreement and a sense of mutual need in order to increase capacity and capability in a particular line of businesss. In its implementation, the agreement carried out by PT Duta Palma Nusantara with indigenous peoples in Kenegrian Siberakun kuansing regency experienced several problems, namely the PT did not carry out the contents of the an agreement in which the PT should have to create an oil palm plantation with the KKPA pattern for the indigenous people of Siberakun kenegrian. The purpose of writing this thesis, namely First to find out the implementation of the customary land management agreement between PT Duta Palma Nusantara and indigenous peoples in the Kuantan singing district, Second for knowing the efforts that can be carried out in the implementation of the customary land management agreement between PT Duta Palma Nusantara and the indigenous peoples in the Kuantan singing district.
By using the method of sociological law. This type of sociological legal research is a study of the prevailing legal tenure and what happens in reality in society. Or in other words, it is a study carried out on the state of sebenarnya or the real state that occurs in society with the intention of knowing and finding the facts and data needed.
From the results of the problem research, there are two main things that can be concluded First, the Implementation of the Ulayat Land Cooperation Agreement between PT. Duta Palma Nusantara with the Benai Subdistrict Community (Including The Siberakuan Kenegrian consisting of 6 Villages) has not run optimally because not all the contents of the agreement have been implemented by PT. Dulta Palma Nusantara is mainly in the Development of KKPA Pattern Oil Palm Plantations for Siberakun area of 675 Ha but has not been realized until now. Second, The efforts that can be made by indigenous peoples of Siberakun state include: a. Litigation and Non-Litigation. The author's suggestion, First, it is hoped that PT Duta Palma Nusantara will carry out the contents of the agreement that has been made with indigenous peoples in the kuansing patent, Second, it should be the community Benai sub-district, especially the Siberakun kenegrian, continues to maintain conduciveness by conducting litigation and non-litigation efforts so that this oil palm plantation development agreement can be it is carried out, but if the agreement is not fulfilled by PT Duta Palma Nusantara, the customary land that has been used should be returned to indigenous peoples.
