Perlindungan Hukum Tenaga Kerja Pt. Richtie Global Terhadap Keterlambatan Pembayaran Upah
ABSTRACT
This study aims to find out how the legal protection for PT. Richtie
Global for late payment of wages. The formulation of the problem posed is how is
the legal protection for PT. Richtie Global regarding late payment of wages and
how to resolve delays in payment of labor wages at PT. Richtie Global.
The type of research used is sociological juridical, namely research
conducted by identifying the law and how the effectiveness of the implementation
of the law applies in society. Because in this study the authors directly conducted
research at the location or place under study to provide a complete and clear
description of the problem under study.
The theory used in this study is the concept of labor. The results of the
analysis in this study indicate that there has been a violation of the law committed
by the contractor PT. Richtie Global to the workforce, namely related to delays in
the payment of wages, in which the payment of wages to the workforce must be
given according to the time specified in a work agreement and has been agreed by
both parties.
The conclusions that can be obtained from the results of the study are
First, Legal Protection for PT. Richtie Global for late payment of wages in work
agreements at PT. Richtie Global was made unilaterally, namely with the business
owner only, hereby this agreement is called a standard agreement, it can also be
called a standard agreement, meaning in English it is called a standard contract
or standard agreement. As for legal protection for workers who experience delays
in wages at PT. Richtie Global is entitled to labor rights and obligations listed at
the beginning of the work agreement. In this case, it is regulated in the Manpower
Act explaining the rights and obligations of a worker in carrying out his work
where the law functions to protect and limit the status of the rights and
obligations of workers from employers in accordance with human dignity. within
the scope of work. Second, Settlement of Late Payment of Labor Wages at PT.
Richtie Global there are several stages of the procedure carried out in the first
stage, namely with educational efforts to develop/preventive steps. If the first step
does not produce results, the Manpower Office will continue with the second step,
namely Non-Justicial Repressive efforts. Then, if the Examination Memorandum
also does not produce results, then the last (third) way to be taken is by Pro-
Justential Repressive efforts, namely law enforcement measures through the local
Industrial Relations Court.
