Implementasi Pasal 106 Peraturan Daerah Kota Pekanbaru Nomor 07 Tahun 2012 Tentang Retribusi Izin Mendirikan Bangunan Terhadap Pemilik Ruko Yang Menambah Bangunan Melewati Garis Sempadan Bangunan (Gsb) Di Kota Pekanbaru
ABSTRACT
Local governments have an interest in building permits. In order to realize the implementation of the construction of a building, whether carried out by private or private parties who have a business function, they are required to have a Building Construction Permit (IMB) and this permit is needed to fulfill one of the development requirements. However, since the Job Creation Law was enacted, the Building Permit has changed to a Building Approval. Based on interviews with the Pekanbaru City One-Stop Service Investment Agency, there were no significant changes to the terms of building permits. The only difference is the administrative flow and procedures for applying for permits. One of the provisions in building permits is the Building Boundary Line (GSB). For Jalan HR Soebratas the building must have a GSB along 40 meters from the axle of the road. The reality is that there are still many buildings, especially shophouses, adding to the building crossing the building boundary line. Some of the consequences are the occurrence of congestion because the land that should be used for parking is used. Based on the Pekanbaru City Regional Regulation Number 07 of 2012 concerning Retribution for Building Permits to be precise in Article 106, there are administrative sanctions imposed on violators of the Regional Regulations, especially shop owners who add buildings through the GSB. The purpose of this study is to find out how far the implementation of Article 106 of Regional Regulation No. 7 of 2012, what are the factors that have caused the regional regulation not to be implemented and what efforts will be made.
This research is a sociological legal research, namely research that looks at the relationship between law and society with the gap between the law that should be and the law that actually occurs. The research was conducted at the Pekanbaru City One Stop Service Investment Service and at the Pekanbaru Civil Service Police Unit. This study also contains questionnaires distributed to shop owners in Pekanbaru City. Data collection techniques through interviews, questionnaires and literature review.
From the results of research that has been done, the implementation has been going quite well. This is because the relevant agencies move through reports or complaints. Factors that cause administrative sanctions not to work properly are the lack of members from each agency, inadequate facilities and infrastructure and budget. Efforts are made by embracing local officials such as RT/RW/Lurah to carry out supervision in their respective areas, conducting outreach and the last effort is to control and enforce the law.
