This research is motivated by the differences in authority to handle unfair business competition cases between Indonesia and Malaysia. This research aims to explore and compare the authority and practices of search and seizure possessed by the Business Competition Supervisory Commission (KPPU) in Indonesia and the Malaysian Competition Commission (MyCC). in handling cases of unfair business competition. In the era of economic globalization, effective business competition law enforcement is the main key in maintaining market fairness and preventing practices that harm consumers and competitors. Therefore, a deep understanding of the powers and practices of antitrust and business competition agencies in various countries is very important.
Both institutions, namely KPPU and MyCC, were established with similar objectives, namely to protect consumer interests, ensure fair business competition, and prevent practices that are detrimental to competition. However, there are differences in the legal framework and antitrust policies between Indonesia and Malaysia which are reflected in the authority and search and seizure practices of the KPPU and MyCC.
This type of research can be classified into a type of normative legal research, namely examining a number of statutory regulations relating to the regulation of elements of equality in essence which are then classified based on the chronology of the parts regulated by these regulations. Only articles which contain legal rules are analyzed, then construction is carried out by inserting certain articles into categories based on the basic understandings of the legal system, or also called research into legal systematics.
The results of this research show difference in the authority to resolve unfair business competition cases in resolving unfair business competition cases. The difference between KPPU and MyCC lies in the scope of search and confiscation authority possessed by both institutions. MyCC has the authority to carry out searches and confiscations to search for evidence, while the KPPU does not have the authority in this matter.
