Competition in the market often there are activities monopoly resulting in high prices due to market power by businessman. This certainly makes the restlessness to consumers and small businesses due to not get the price varied and reasonable prices, while for businesses can not compete. Moreover the existence of monopolistic practices and unfair competition when examined in the framework of economic democracy Article 33 Undang-Undang Dasar 1945, is incompatible with the constitution. Undang-Undang 1945 mandates that the national economy should be run by promoting people's welfare as their goal setting law and justice. Therefore, the presence of the government is needed to realize the ideals mandated by the Constitution and Undang-Undang Nomor 5 Tahun 1999 about Prohibition of Monopolistic Practices and Unfair Business Competition and Undang-Undang Nomor 8 Tahun 1999 about Consumer Protection. So that Law and justice can be felt by everyone.
This study intends to analyze the mechanisms and criteria for state intervention in order to provide legal protection to consumers and other businesseman in creating healthy business competition. This study uses doctrinal method research in the form of evaluative research. The approach which is used is the approach of legislation with secondary data sources in the form of primary, secondary and tertiary legal materials.
The research showed that the mechanism of state intervention is likethe delimitation of the price tolerance 10 % for rice, granting subsidies (Harga/BLT), market operations, tariff Arrangement of Impor Tax, Price Determination of Government Purchase (HPP), Restrictions of food exports. However, this policy has not been effective due to the economic laws that govern it can not predict the problems that occur in the future and the differences in understanding and ideology of the political parties of establishment the policy resulted not bring benefit to perfection While the criteria for state intervention is the production branches which are important for the country and dominate the life of many people, the production branches are arranged legislation, organized by the state (BUMN) or body or institution established or designated by the government.
