Perlindungan Hukum Terhadap Whistleblower Dan Justice Collaborator Dalam Tindak Pidana Korupsi

The issue of Whistleblower or Justice Collaborator is a complicated issueand appealing to be discussed in a conception or formalization. Whether a Whistleblower and Justice Collaborator is a criminal or non-criminal, or do we need a special award or punishment considering the indispensable role of the Whistleblower and Justice Collaborator in revealing an exceptional crimes such as corruption, so that the formulation of the problem that can be put forward relating to the legal phenomenon, are: 1) How does the legal protection of the Whistleblower and Justice Collaborator in Law Corruption crime in Indonesia, and 2) How does the concept of legal protection of criminal law policy to the Whistleblower andJustice Collaborator in the future of corruption in Indonesia. This research is a normative legal research, with legislation approach, the conceptual approach and comparative approach. Legal materials used consisted of primary legal materials, secondary law and tertiary legal materials.

Mechanical collection of legal materials collected through systematic method with recorded through the card system to facilitate analysis of the issue. Then the technique for analyzing legal materials using techniques and descriptions developed and assessed by the interpretation method, if the material has been described and interpreted the law in accordance subject matter, further systematized, explained and given argument.

These results indicate that the lack of adequate legal protection received by the Whistleblower or Justice Collaborator in Corruption Law due legal protection to Justice Collaborator and Whistleblower done when doing community participation to assist in the prevention and eradication of corruption addition, the concept of policies criminal law against the Whistleblower and justice Collaborator in corruption in the future-oriented dimension of the concept of non-penal approach is the approach of restorative justice and legal protection of people working together then the imposition of criminal law with criminal conditional special, special remission and conditional release accelerated and Whistleblower protection models and Justice Collaborator.
