ABSTRACT
This study aims to determine the implementation, constraints and efforts of
the Correctional Center as an institution that has a supervisory function for
juvenile offenders who have received a diversion agreement in the Legal Area of
the Indragiri Hulu Police.
This research uses empirical legal research or sociological legal research.
The sample in this study was the Head of the Women and Children Service Unit of
the Indragiri Hulu Police, the Head of the Legal Division of the Riau Province
Correctional Center, the Head of the Sub-Division for Children of the Indragiri
Hulu Prison, Victims of Child Crime in the Legal Area of Indragiri Hulu. The
analytical tool in this research is the inductive method. This study found that there
are things that are not optimal in the implementation in the field, so it is necessary
to anticipate them with solutions.
This study concludes that the implementation of the supervisory function
carried out by Bapas against child offenders who has received a diversion
agreement has not been maximized in reality. This is because the apparatus is still
hesitant in implementing the stipulated provisions. Because community demands
are also a special consideration for law enforcement officials. The authorities are
also afraid of being blamed in the future if the perpetrator of the criminal offense
repeats his actions. In addition, there are also several obstacles in the
implementation of diversion against child crimes, such as internal obstacles that
include different understandings between law enforcement officers and another,
lack of cooperation between the parties involved, bureaucratic ethics issues.
Meanwhile, the external obstacles include the lack of support and cooperation
between institutions, the victims and their families who do not agree with the
diversion, and there is still uncertainty regarding regulations regarding the
implementation of the results of the agreement from the diversion itself. As for the
efforts that can be made by the Correctional Center against the perpetrators of
criminal acts who have received diversion, such as by creating coordination,
communication and synergy between authorized law enforcement agencies. Then
by providing an understanding to the community regarding the urgency of the
diversion and by strengthening the implementation of child regulations after
getting diversion.
