Pertanggung Jawaban Pidana Masyarakat Yang Mengetahui Adanya Transaksi Narkotika
ABSTRACT
Narcotics are substances or drugs derived from plants or nonplants,
both synthetic and semi-synthetic, which can cause a decrease or
change in consciousness, loss of taste, reduce pain and can lead to
dependence. People who are aware of the existence of narcotic
substances but do not report them may still be subject to Article 131 of
Law Number 35 of 2009 concerning Narcotics. Until now, the existence
of Law Number 35 of 2009 concerning Narcotics, especially regarding
articles 131 and 134 paragraph 2 concerning the role of the public in
reporting the existence of narcotics crime has not raised public
awareness in eradicating narcotics abuse syndicates. Based on this
understanding, the authors identify two problem formulations, First,
what are the boundaries of society that can be held responsible for the
crime. Second, how is regulatory reformulation for people who are
aware of narcotics transactions.
This research method The author has not found a community
boundary that can be held accountable for the criminal case of narcotics,
whether the elements of everyone can be held accountable in narcotics
cases. The legal uncertainty of each case that occurs at this time is the
need for clarity or a correct policy regarding the articles in the Narcotics
Law, the need for a special Narcotics criminal law policy to realize
statutory regulations so that it is in accordance with certain
circumstances of time (ius constituentum) and the period to be come (ius
constituendum).
The need for a community boundary which can be held
accountable for knowing or not knowing the existence of Narcotics
transactions in the role of society Article 104 of the Narcotics Law.
Related to article 131 of Law No. 35 of 2009, it is necessary to
reformulate because the element of everyone in Article 131 is a problem,
whether someone must see directly or know enough information but not
report can be punished and said to be a criminal omission.
