The general election is an important mechanism in a country , especially those using the type of political system of Liberal Democracy . Generally, there are four clumps of electoral systems : plurality - majority , proportional representative , a mix between the plurality - majority and proportional . According to Law No. 8 of 2012 concerning the election of members of DPR , DPD and DPRD electoral system used is an open list proportional system , which voters are able to vote for the party and the people's representatives at the same time . So that the elected candidates of the political parties are no longer determined by the political party that won the election . The selection of candidates elected in the proportional system that is open to the determination of the majority of votes contained in article 215 of Law No. 8 of 2012 on the election of members of DPR, DPD , DPRD . In Article 7 of Law No. 8 of 2012 on the election has membership DPR , DPD, which is where the political parties still have an important role in determining where the elected candidate is not in accordance with article proporsinal open system that emphasizes the role of society in determining a candidate elected in an election general .
This type of research is classified in this type of normative research , because in this study the authors conducted a study of the principles of law and legal systematics . While the source of the data used is using secondary data . Data collection techniques in this study the authors use the method of literature study .
From the research, there are two main issues are concluded . First , open proportional system settings contained in article 215 of Law No. 8 of 2012 on Election of Members of the House of Representatives, Parliament is by majority vote . So according to the law no longer participating in the election using sequence numbers and figures BPP . For it in the upcoming 2014 elections are no longer the same as the previous election that many voters and harm people's representatives who participated in the election in terms of vote counts to determine the elected candidate . Second , there is a contradiction between Article 5 and Article 7 of Law No. 8 of 2012 on the Election of Members of DPR , DPD , DPRD . Where Article 5 mentions electoral system used is proportional open list system , while chapter 7 participants Provincial Council election , the council district / city is the proportional system politik.dimana party can choose parties and candidates seeking election by the people , while in chapter 7 explains that voters can only select political parties and candidates for election determined only by the political parties . Authors suggested , first , that the 2014 election should come to be better than the previous election that democracy aspired to run smoothly in accordance with Law No. 8 of 2012 on the Election of Members of DPR , DPD , DPRD . Open- list proportional system candidates with the most votes can be carried out honestly and fairly in accordance with Law No. 8 of 2012 on the Election of Members of DPR , DPD , DPRD . Second , Article 7 should be abolished because it is not in accordance with the proportional electoral system in order to open the 2014 elections went smoothly and there is no debate among political parties in determining the selected candidates .
