Tinjauan Kewenangan Pembentukan Undang-Undang Sebelum Dan Sesudah Amandemen Undang-Undang Dasar Negara Republik Indonesia Tahun 1945

Prior to the change in the Constitution of 1945 in our constitutional practice there is authority that the Executive President heave in the field of country life , the one that stands out is the scope of the formation of the Law , and having made changes in the case of the 1945 Constitution authorizes the formation of Law law has moved to the House of Representatives . By shifting authority in the formation of this Law , the author seeks to examine the differences , track changes , and find out the advantages and disadvantages of the formation of the Law before and after the amendment to the 1945 Constitution .
Research conducted is normative legal research , research that is done to approach the history of law and legal foundations . In this study , the authors use primary data secondary data , and data tertiary .
Results of this study showed that when there is a change to the Constitution of the Republic of Indonesia Year 1945 , pursuant to Article 20 paragraph (1 ) First change that reads " House of Representatives form the Power Holding Law" . Formulation of Article 20 paragraph (1 ) is a change from Article 5 paragraph ( 1) of the old saying " the President of the saddle shape with the consent of Laws House of Representatives " . And that this change ie melatar belakangi to create checks and balances in the system ketata nationalization . With this shift there are advantages and disadvantages such as : pre- made changes in the system of checks and balances legislation is not there , but once done change that checks and balances have started to appear . A further advantage of that is the House of Representatives has begun productive , previously stifled. Not only this advantage , having done it there is a lack of change such as , loss of rights in a Presidential veto the bill verification , which results in the Law without confirmation , resulting in the absence of certainty Law
