As mandated by the Constitution of the Republic of Indonesia Year 1945, the territory of the Republic of Indonesia is divided into Provincial and Provincial subdivided into Regional District and the City, each as an autonomous region. As an autonomous region , Provincial , District / City has the Local Government carry out the functions of local government. Chief government administrator in the area as the area assisted by a deputy head of the region, it is stated in Article 24 Paragraph ( 3 ) of Law Number 32 Year 2004 on Regional Government . The deputy head of the region in this rule only help execute specific tasks of regional head and replace the head area if absent. But also noteworthy is the presence of deputy head of the inseparable unity, are chosen in pairs by the people and at the same time leading the local government in accordance with instructions of Law Number 32 Year 2004 on Regional Government.
The formulation of the issues raised in this research is how the authority of regional head and deputy regional head based on Law No. 32 of 2004, how is the relationship of authority and the regional head and deputy regional head ideal settings related to how the division of authority regional head and deputy head of the regional administration in organizing.
The author conducted research using the normative literature study in order to obtain secondary data through a document that is by collecting , studying and analyzing theories and laws and regulations relating to the subject matter covered.
In this study explained that the authority of the regional head and deputy regional head provided for in article 25 and 26 of Law 32 of 2004 on Regional Government in the implementation of the authority but has not been able to run optimally as it needs to be regulated more firmly in a government regulation particularly in view of the authority relationship both leaders.That the deputy head has five possible positions of the head area , namely , the deputy head of the region , as a companion to the head region , the regional head maid , instead of as a regional head and deputy regional head who is independent . Related to the division of powers ideal setting regional head and deputy regional head is regulated in detail in the Act or Regulation Government because this pattern will provide legal certainty what the authority of regional head and deputy regional head so conducive government can run without internal conflict and external happens in both lead the government in the area.
