ABCTRACT
Indonesia is one of the many developing countries that use social media.
This can be seen from the many users of communication tools that aim to make it
easier for people to get information from one to the other. The conditional turned
out to open a lot opportunities for parties who are not responsible for mususing
social media, one of them is the illegal sale and purchase of cosmetics, which is
very dangerous to public health when used. In this day and age, with the
prensence of social media, there are many sales or promotion methods that can be
used. One of the things that is new is by means of promotion through
endorsements carried out by celebrities. Based on this understanding, the authors
formulated two problem formulations, namely: First, How is the criminal liability
for illegal cosmetic bussiness actors by online? Second, How is criminal liability
of artists who play a role in endorsing ilegal cosmetics by online?
This type of research can be classified in normative legal research or
also called research literature by examining secondary legal materials or
research based on standard rules that have been recorded is also called
bibliography research, the type of data used is using secondary data consisting of
primary, secondary and tertiary legal material. While the data collection used in
this writing is the method of literature review or documentary study.
From the results of this: First, How is the criminal liability for illegal
cosmetic bussiness actors by online still not effective and comprehensive to all
parties involved and clearly proven to violate Law number 36 of 2009 concerning
health. Second, How is the criminal liability of artists cosmetic who play a role in
endorsing illegal cosmetics by online there is no firmness on the part of law
enforcement officials in giving sentences for endorsement artists so that there is
no deterrent effect to endorsement artists promoting illegal cosmetic products.
