Konsep Penyelesaian Sengketa Batas Wilayah Antara Desa Sering Dengan Desa Lalang Kabung Dikaitkan Dengan Pemekaran Desa Di Kabupaten Pelalawan
Of the many villages in the Pelalawan area, there is a village that has been
expanded, namely Lalang Kabung Village and part of the village has been
expanded to become Frequent Village, but the village community still does not
agree with the village boundaries that have been divided by the government,
causing disputes and territorial disputes as well as changes in the administrative
system. The main problem arising from this division is that the boundaries of
areas that claim each other are areas that are still territories, the area is seen as
a productive area and has economic value to advance the village. The formulation
of the problem is how the efforts made by the local government towards territorial
boundary disputes between villages are often with Lalang Kabung villages in
Pelalawan Regency, how is the concept of resolving territorial boundary disputes
between villages often and Lalang Kabung villages associated with the division of
villages in Pelalawan Regency. This research method is sociological law, where
the author collects data from field facts which the writer analyzes qualitatively.
The results showed that the efforts made by the local government to dispute
territorial boundaries between villages often with Lalang Kabung Village in
Pelalawan Regency were carried out in a non-litigation way, namely by
negotiation and also by means of mediation, but the settlement was not resolved.
While the concept of resolving territorial boundary disputes between villages
often with the village of Lalang Kabung can be done in two ways, namely; (1),
through a decision of the authorized official/tuning agency, namely by the
governor if a territorial boundary dispute occurs between autonomous
regencies/municipalities within a province, and by the Minister of Home Affairs if
a territorial boundary dispute occurs between provinces, then (2), through a court
decision namely by PTUN and MK.
