ABSTRACT
One form of crime that we often find with a background of wanting to
enter goods without a permit process is smuggling. This type of crime is almost
often carried out in an attempt to be able to enter goods without a permit process
through a shortcut. The crime of smuggling is a criminal act committed by a
person or group of people by means of importing (importing) or exporting
(exporting) goods without complying with the various provisions of the prevailing
laws and regulations, which violates the law and is detrimental to the state. There
is a lot of smuggling that occurs in Indonesia. including oil smuggling. The
smuggling of oil occurs in the form of exports and imports. This is due to the
geographical conditions of the Republic of Indonesia which consists of the earth's
territory including 17,504 large and small islands, 6,000 uninhabited islands
which stretch 3,977 miles.
This type of research can be classified in the type of sociological legal
research (empirical), because in this study the author directly conducted research
at the location or place being studied in order to provide a complete and clear
picture of the problem under study. This research was conducted at the Pelalawan
Resort Police, while the population and sample were the Head of the Reksrim
Pelalawan Police, Economic Midwife Investigators and the Surrounding
Community. The data sources used are primary data and secondary data. Data
collection techniques in this study were interviews and literature review.
The conclusions that can be obtained from the research results are First,
the implementation of law enforcement against illegal oil smuggling in the
jurisdiction of the Pelalawan Resort Police is quite high and has experienced an
increase. However, the increase in law enforcement is not proportional to the
increase in the crime of smuggling illegal oil in Pelalawan Regency and if it is
seen that illegal oil smuggling is not done once or twice, but has often even
increased very rapidly. Second, the obstacle for investigators to enforce the law
against illegal oil smuggling in the jurisdiction of the Pelalawan Resort Police is
the characteristics of the Pelalawan Regency area which is a position that is
directly opposite to several areas that are prone to smuggling. Economic and
cultural characteristics of local communities (reasons for livelihoods). Third, the
ideal concept in overcoming illegal oil smuggling in the jurisdiction of the
Pelalawan Resort Police by carrying out a process of socialization, raising and
implementing the provisions in stages; To carry out internal and external
coordination (related agencies); Assign the apparatus to the supervisory area in
order to collect data / information as well as request data from the relevant
agencies which is then used for intelligence analysis for the target of surveillance
operations, Conducting market operations; as well as maximizing existing
facilities and infrastructure.
